involves offering guidance on the application of the law and governing document provisions to matters of business, administration and operation of the Association. We are asked to offer advice on the scope of authority of the Board members, contract review and interpretation, labor and employment advice, as well as any other legal issue which can arise and impact a common interest community association.
MercerTrigiani attorneys have extensive experience in negotiating both simple and complex contracts, and advising community associations on contract enforcement. We are often asked to assist the Board in determining maintenance and repair responsibility. We assist our community association clients on document interpretation issues with a solution-oriented philosophy, applying practical judgment while respecting the integrity of the Association's legal foundation - the governing documents. MercerTrigiani attorneys believe strongly that preventive counseling avoids serious legal problems. We prefer to give the Board the tools and information essential to the conduct of routine association business through periodic training, legal updates and standard forms. We want to develop long-term relationships with our clients because the client is better served by having legal counsel familiar with their unique character and history of the community. We do this by requesting and reviewing Board meeting minutes and the association newsletter, as well as periodic attendance at Board meetings. |
